CCPA and CPRA Supplemental Privacy Notice for California Residents

This Supplemental Privacy Notice for California Residents supplements the information contained in the TechResearch Privacy Policy and applies solely to California residents who visit or use the TechResearch website and services.

This Notice is provided pursuant to the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and explains how TechResearch collects, uses, discloses, and protects personal information, as well as the rights available to California residents under applicable California privacy laws.

This Supplemental Privacy Notice for California Residents applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you"). This notice supplements the information contained in the TechResearch Privacy Policy and is provided in accordance with the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act (CPRA). Unless otherwise defined in this notice, terms used herein have the same meaning as defined under the CCPA, as amended by the CPRA.

Personal Information does not include:

1. Publicly available information lawfully made available from federal, state, or local government records.

2. Deidentified or aggregated information that cannot reasonably be linked to a particular consumer or household.

3. Information excluded from the scope of the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including:

• Protected Health Information (PHI) governed by the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the California Confidentiality of Medical Information Act (CMIA), or clinical trial data.

• Personal information regulated by certain federal and state privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), the California Financial Information Privacy Act (FIPA), the Driver’s Privacy Protection Act of 1994 (DPPA), and other applicable sector-specific privacy laws. 

TechResearch obtains the categories of information listed above from the following categories of sources:

• Directly: for example, when you send us an email via the email addresses listed on our website.

• Indirectly: for example, by observing your actions on our Website; by placing online identifiers such as cookies, pixel tags, and IP addresses..

We may use, disclose, or share the personal information we collect for one or more of the following purposes:

• To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request information about our services, we will use that personal information to respond to your inquiry

• To process your requests for white paper downloads

• To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses

• To personalize your website experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our Website, third-party sites, and via email or text message (with your consent, where required by law)

• As described to you when collecting your personal information or as otherwise set forth in the CCPA.

TechResearch will not collect additional categories of personal information or use, disclose or share the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice. 

Sharing personal information:

TechResearch may share your personal information with third parties, subject to your right to opt out of such sharing. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. The CPRA prohibits third parties who receive the personal information we share from using it for any purpose other than the purpose for which it was shared, unless you have received explicit notice and an opportunity to opt-out of such further sharing.

Disclosures of Personal Information for a Business Purpose:

During the preceding twelve (12) months, TechResearch may have disclosed certain categories of personal information to service providers and contractors for legitimate business purposes, including operating our website, analytics, security, communications, and technical support.

The categories of personal information that may be disclosed include:

• Identifiers (such as IP address, email address, cookies, and online identifiers)

• Personal information described in California Customer Records (where voluntarily provided)

• Internet or other electronic network activity information

• Professional or employment information (if submitted through forms or career inquiries)

We may disclose personal information to the following categories of recipients:

• Website hosting providers

• Analytics providers

• Email and communication service providers

• IT and security service providers

• Other vendors and contractors that process personal information on our behalf

All disclosures are made solely for business purposes under written agreements that require recipients to protect personal information and use it only for the services they provide to TechResearch. 

Your Rights and Choices:

The CCPA, as amended by the CPRA, provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

You have the right to request that TechResearch disclose certain information to you about our collection use, disclosure and sharing of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will provide you with the following information:

• The categories of personal information we collected about you

• The categories of sources for the personal information we collected about you

• Our business or commercial purpose for collecting, using, disclosing or sharing that personal information

• The categories of third parties with whom we share that personal information

• The specific pieces of personal information we collected about you (also called a data portability request)

• If we disclosed or shared your personal information, two separate lists disclosing

• sharing, identifying the personal information categories that each category of recipient received; and

• disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained 

Deletion Request Rights:

You have the right to request that TechResearch delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

1. Complete the transaction for which we collected the personal information, provide a service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

• Exercise free speech, ensure the right of another consumer to exercise their free speech rights or exercise another right provided for by law.

• Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

• Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.

• Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

• Comply with a legal obligation.

• Make other internal and lawful uses of that information that are compatible with the context in which you provided it. 

Exercising Access, Data Portability, and Deletion Rights:

California residents may exercise their rights to know, access, correct, delete, and obtain a copy of their personal information, as provided under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

Only you, or a person legally authorized to act on your behalf, may submit a verifiable consumer request related to your personal information. You may also submit a request on behalf of your minor child where permitted by applicable law.

A verifiable consumer request must provide sufficient information that allows us to reasonably verify your identity or your authority to act on behalf of another individual. The request should also include enough detail for us to understand, evaluate, and respond appropriately.

We may request additional information if necessary to verify your identity before processing your request. Any information collected for verification purposes will only be used to process your request and will not be retained for any other purpose unless required by law.

You are not required to create an account with TechResearch to submit a verifiable consumer request.

Where applicable under California law, you may submit a request to know or access your personal information up to twice within a 12-month period.

Response Timing and Format:

TechResearch will acknowledge and respond to verifiable consumer requests in accordance with applicable California law. We will confirm receipt of your request within the time required by law and endeavor to provide a substantive response within forty-five (45) days of receiving a verifiable consumer request.

We will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination:

TechResearch will not discriminate against you for exercising any of your rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

• Deny you any services

• Charge you different prices or rates for services, including through granting discounts or other benefits, or imposing penalties

• Provide you a different level or quality of services

• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services

Changes to Our Privacy Notice:

TechResearch reserves the right to update or modify this Supplemental Privacy Notice at any time to reflect changes in our business practices, applicable laws, or regulatory requirements, including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

 When we make material changes to this Notice, we will post the revised version on this page and update the "Last Updated" date at the top of this Notice.  We will notify you of material changes by posting a prominent notice on our website at least 30 days before such changes take effect. Any non-material changes become effective upon posting.
